My home has been sold at foreclosure – Is there any way for me to get my house back?
Maybe, but the road in front of you will be an uphill battle. First, the best situation is to contact a bankruptcy lawyer or foreclosure lawyer prior to the foreclosure date where there are many options available to you. Filing bankruptcy prior to foreclosure date will automatically stay or stop the sale.
But what if the sale has already passed?
If you are in the unfortunate situation of having already suffered through a home foreclosure you may be able to have the foreclosure sale undone while in chapter 13 bankruptcy and then get on a plan to get current with the mortgage payment.
In order to successfully put this plan in action there must have been some improper action by the bank or their lawyer during the foreclosure process.
You should understand that it is unlikely to have the foreclosure overturned and legal fees will be much larger than in a standard case. But if the bank did act improper you may still be able to get your home back.
