Student Loans and Bankruptcy Prior to October 7, 1998
Prior to October 7, 1998 student loans, federal or private, were dischargeable in bankruptcy. However, the loan had to be in repayment for more than 7 years. I think this was more than fair to lenders and borrowers as the borrower had to spend a considerable amount of time and effort to repay the loans prior to discharge.
Today, student loans are not dischargeable in bankruptcy without a showing of undue hardship.
